New guidelines came into effect on Monday 1 February for England and Wales which mean that professionals within the food industry whose actions result in harm or risk of harm to consumers could lead to custodial sentences.

Following a consultation last year, the Sentencing Council (promotes greater consistency in sentencing, whilst maintaining the independence of the judiciary. The Council produces guidelines on sentencing for the judiciary and criminal justice professionals and aims to increase public understanding of sentencing) has now published its definitive guidelines covering health and safety, corporate manslaughter and food safety and hygiene offences.

The publication of the guidelines means that for the first time, courts in England and Wales will have comprehensive sentencing guidelines covering the most commonly sentenced health and safety offences and food safety offences.
